1. Purpose
These General Terms and Conditions of Sale define the rights and obligations between BIMPAIR Suspension and its customers in connection with the sale of products through the website. Any order implies full and unconditional acceptance of these terms.
2. Scope of Application
These terms apply to all sales made through the website to private individuals and professional customers. They prevail over any other document unless otherwise agreed in writing.
3. Products
Products are described and presented as accurately as possible. However, minor variations may occur due to technical constraints or improvements. Photos and descriptions are non-contractual.
4. Orders
Orders are placed through the website. An order becomes final after validation of the cart, acceptance of the terms, and confirmation of payment. BIMPAIR Suspension reserves the right to refuse any order in case of prior dispute or payment default.
5. Prices
Prices are indicated in euros, including taxes. BIMPAIR Suspension reserves the right to modify prices at any time. The applicable price is the one in force at the time of order.
6. Payment
Payment is due in full at the time of order. Accepted payment methods are indicated on the website. Any unpaid order will not be processed. Late payments may result in penalties in accordance with applicable law.
7. Delivery
Products are delivered to the address provided by the customer at the time of order. Delivery times are indicative. BIMPAIR Suspension cannot be held responsible for delays caused by carriers. Risks are transferred to the customer when the goods are handed over to the carrier.
8. Receipt of Products
Customers must check the condition and conformity of the products upon receipt. Any anomaly must be reported within 48 hours. Failing this, the products will be deemed compliant.
9. Right of Withdrawal
In accordance with the law, customers have a period of 14 days from receipt to exercise their right of withdrawal, except in legally excluded cases. Requests must be made in writing. Returned products must be in perfect condition. Return shipping costs remain the responsibility of the customer.
10. Returns and Refunds
Return and refund procedures are defined in the Return and Refund Policy available on the website. No return will be accepted without prior authorization.
11. Warranty
Products benefit from the legal warranty of conformity and the warranty against hidden defects. They are also covered by a two-year contractual warranty. The warranty does not cover normal wear and tear, misuse, or unauthorized modifications.
12. Liability
BIMPAIR Suspension’s liability is limited to the amount of the relevant order. It cannot be held responsible for indirect damages such as loss of business, loss of revenue, or loss of profit.
13. Intellectual Property
All elements of the website, including texts, images, logos, trademarks, and content, are protected by intellectual property law. Any reproduction without prior written authorization is prohibited.
14. Personal Data
Personal data collected is processed in accordance with applicable regulations. Details are provided in the Privacy Policy.
15. Force Majeure
BIMPAIR Suspension shall not be held liable for failure to perform due to force majeure events, including strikes, natural disasters, pandemics, administrative decisions, or shortages.
16. Modification of the Terms
BIMPAIR Suspension reserves the right to modify these terms at any time. The applicable terms are those in force at the date of order.
17. Governing Law and Disputes
These terms are governed by French law. Any dispute relating to their interpretation or execution shall fall within the jurisdiction of the competent courts at the registered office of BIMPAIR Suspension.
